XECES Terms of Service

These Terms of Service (the "Agreement") govern your use of the website, hosting, email, domain, and related services (collectively, the "Services") provided by Xeces Technologies ("XECES", "we", "us", "our"). By placing an order, creating an account, or using any XECES Service, you ("Customer", "you", "your") agree to be bound by this Agreement, our Acceptable Use Policy, and our Privacy Policy, all of which are incorporated by reference.

If you do not agree to these terms, do not use XECES Services.

1. Eligibility

The person placing an order and responsible for billing must be at least 18 years of age, or the age of legal majority in their jurisdiction, since this Agreement is a binding contract. If you are under this age, a parent, guardian, or other adult may register and remain the responsible account holder for services you use or manage.

2. Account Registration

You agree to provide accurate, current, and complete information when placing an order or creating an account, and to keep this information updated. XECES is not responsible for service disruptions, missed renewal notices, or account issues resulting from outdated or inaccurate contact information on file.

3. Services Provided

XECES provides shared and reseller-based web hosting, professional email hosting, domain registration and transfer facilitation, and related services as described on our website at the time of purchase. Specific plan limits (storage, bandwidth, number of websites, email accounts, and similar limits) are as stated on the relevant plan page at checkout and are subject to our Acceptable Use Policy.

5. Cancellations

You may cancel any service at any time by requesting cancellation directly from your billing portal, or by contacting us before your next renewal date. Cancelling a service stops future renewals; it does not retroactively adjust charges already applied for the current billing period.

Our infrastructure includes automated daily backups with a rolling window of restore points, accessible and restorable by you directly through your hosting control panel. This is provided as a convenience, not a guaranteed data protection service, and the retention window may change. You are responsible for maintaining your own independent backups of any content, files, databases, and email hosted with XECES. XECES is not liable for data loss and recommends customers keep independent backups of anything critical.

9. Acceptable Use

Your use of the Services is subject to our Acceptable Use Policy, published separately. Violation of the Acceptable Use Policy may result in suspension or termination of your Services as described there.

10. Limitation of Liability

To the maximum extent permitted by applicable law, XECES and its officers, employees, and affiliates are not liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Services, including but not limited to loss of data, loss of revenue, or loss of business opportunity. XECES is not responsible or liable for the content that any customer uploads, hosts, publishes, or transmits using our Services, including where that content is later found to be unlawful, infringing, or otherwise improper; responsibility for such content rests solely with the customer.

Our Services are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, except as explicitly stated in this Agreement.

11. Indemnification

You agree to indemnify and hold XECES harmless from any claims, damages, losses, or expenses (including reasonable legal costs) arising from your use of the Services, your content, or your violation of this Agreement or applicable law.

12. Third-Party Services

Some Services rely on infrastructure or platforms provided by third parties, including our upstream hosting provider and domain registrars. XECES manages these relationships on your behalf so you don't have to deal with them directly. If an issue originates upstream, we will keep you informed and work to resolve it as quickly as possible, using the same direct support channels you already use to reach us.

13. Changes to This Agreement

XECES may update this Agreement from time to time. Material changes will be communicated where practical. Continued use of the Services after an update constitutes acceptance of the revised Agreement.

14. Governing Law

This Agreement is governed by the laws of Pakistan. Any disputes arising from this Agreement shall be subject to the jurisdiction of the courts of Pakistan.
